4. Processing Your DMCA Notice

After receiving a valid DMCA Notice we will:

  • Review the claim for completeness and validity.
  • If valid, remove or disable access to the allegedly infringing content.
  • Notify the user who posted the material of the removal.
  • Allow the user to submit a Counter-Notice if they believe the removal was in error.
  • Temporarily suspend the user’s ability to post or upload content if necessary, based on severity or frequency of violations.

5. Submitting a DMCA Counter-Notice (For Users)

If your content was removed due to a DMCA Notice and you believe it was removed by mistake or misidentification, you may file a DMCA Counter-Notice. A valid counter-notice must include:

  • Identification of the material that was removed or disabled and the location where it appeared (URL).
  • A statement under penalty of perjury that you have a good-faith belief the content was removed due to mistake or misidentification.
  • Your full legal name, postal address, telephone number, and email address.
  • A statement consenting to the jurisdiction of the federal courts in your district and that you will accept service of process from the person who submitted the original DMCA Notice.
  • Your physical or electronic signature.

6. Restoration of Content After Counter-Notice

If a valid counter-notice is received, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content. Restoration is not guaranteed where the content violates other site policies.

7. Repeat Infringer Policy

aspestos.com enforces a strict repeat-infringer policy. Accounts associated with multiple valid DMCA claims may be suspended or permanently terminated. Users must ensure they upload only original or properly licensed content.

8. Misuse of DMCA Procedures

Submitting false, misleading, or bad-faith DMCA notices or counter-notices is prohibited and may lead to legal liability, including damages and attorney’s fees. Please ensure all claims are accurate and submitted by authorized parties.
